Terms and Conditions for Lexie

These Terms and Conditions (“Terms”) govern your access to and use of Lexie, a Telegram bot designed to help users learn the French language through conversations, exercises, and other educational features.

By accessing or using Lexie, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use Lexie.

1. About Lexie

Lexie is a third-party bot operated independently from Telegram. Lexie is made available through Telegram, but Telegram does not own, operate, maintain, or control Lexie. Telegram’s own bot terms also say that bots are generally owned and operated by third-party service providers and that users may also be subject to the individual bot’s own terms. ([Telegram][1])

Your use of Lexie is also subject to:

Telegram’s applicable Terms of Service
Telegram’s Privacy Policy
Any applicable terms of third-party payment providers used for purchases through Lexie

2. Eligibility

By using Lexie, you represent and warrant that:

you are legally capable of entering into a binding agreement;
you comply with all laws and regulations applicable to your use of the bot;
all information you provide is accurate and complete.

If you are using Lexie on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

3. Educational Purpose Only

Lexie is intended for general educational and informational purposes only.

Lexie is designed to support French language learning, but we do not guarantee:

any specific learning outcome;
fluency, exam success, or improvement level;
accuracy, completeness, or suitability of any response, explanation, translation, or exercise.

You are solely responsible for how you use the information and content provided by Lexie.

4. Purchases and Paid Features

Certain features of Lexie may require payment, including access to usage credits, interactions, subscriptions, bundles, or other paid functionality.

By making a purchase through Lexie, you agree that:

you are authorized to use the selected payment method;
you will pay all applicable charges, fees, taxes, and other amounts shown at the time of purchase;
access to paid features may be limited, suspended, changed, or discontinued at any time.

Telegram’s bot terms state that payments made through bots are processed by third-party payment providers chosen by the bot operator, and that Telegram does not itself process payments or hold funds. ([Telegram][1])

5. No Refunds

All purchases made in or through Lexie are final and non-refundable.

To the maximum extent permitted by applicable law:

we do not provide refunds;
we do not provide partial refunds;
we do not provide credits, reimbursements, or compensation for unused interactions, unused time, inactivity, mistaken purchases, dissatisfaction, account issues, interruptions, service changes, or bot discontinuation.

By purchasing any paid feature in Lexie, you expressly acknowledge and agree to this no-refund policy.

6. Billing, Payment Processors, and Payment Disputes

Payments for Lexie may be processed by third-party payment providers. Telegram’s published bot terms say Telegram does not manage, oversee, verify, or warrant these transactions, and that payment-related disputes must be directed to the payment provider or service provider. ([Telegram][1])

Accordingly:

we may rely on third-party processors to complete payments;
we do not control those third-party services;
we are not liable for payment failures, delays, technical errors, bank charges, currency conversion issues, fraud checks, declined cards, chargeback consequences, or processor outages.

If you initiate a chargeback or payment dispute, we reserve the right to suspend or terminate your access to Lexie.

7. No Guarantee of Availability or Access

We may modify, suspend, restrict, or discontinue Lexie, in whole or in part, at any time, with or without notice.

We do not guarantee that Lexie will:

be available at all times;
work without interruption;
be error-free;
remain compatible with Telegram or any device;
preserve your history, progress, credits, or access.

Telegram’s bot terms also state that a bot may cease operations at any time and that loss of access to bot features, progression, or stored utility may occur without Telegram liability. ([Telegram][1])

8. User Responsibility

You are solely responsible for:

your use of Lexie;
the prompts, messages, text, media, and other content you submit;
verifying any output before relying on it;
maintaining the security of your Telegram account and devices.

You must not use Lexie:

for unlawful, abusive, fraudulent, or harmful purposes;
to harass, threaten, or impersonate others;
to upload malicious code, spam, or disruptive content;
to attempt to reverse engineer, interfere with, or misuse the bot.

We may suspend or block access at our sole discretion if we believe you violated these Terms.

9. Artificial Intelligence Disclaimer

Lexie may use artificial intelligence and automated systems to generate responses. AI-generated content can be inaccurate, incomplete, outdated, misleading, or inappropriate.

You acknowledge and agree that:

outputs may contain mistakes;
responses are generated automatically and may not be reviewed by a human;
you use any output at your own risk.

Lexie is not responsible for any decision, action, loss, misunderstanding, or consequence resulting from reliance on AI-generated content.

10. No Warranties

Lexie is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any warranties of:

merchantability;
fitness for a particular purpose;
non-infringement;
accuracy;
reliability;
availability;
performance.

Telegram’s own bot terms contain similar “as is” and “as available” disclaimers for bot-related services. ([Telegram][1])

We do not warrant that:

Lexie will meet your expectations;
Lexie will help you achieve any educational, personal, academic, or professional result;
any defects will be corrected;
the bot will be secure or free from bugs or harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for anything arising out of or related to your use of Lexie.

This includes, without limitation:

direct losses;
indirect losses;
incidental losses;
consequential losses;
special damages;
punitive damages;
lost profits;
lost revenue;
lost business;
loss of data;
loss of learning progress;
loss of access;
payment disputes;
errors in content;
interruptions or downtime;
technical failures;
unauthorized access;
actions of third parties;
dissatisfaction with the service.

If, despite the above, we are found liable for any claim, our total liability shall not exceed the amount you paid to us for Lexie during the 30 days preceding the event giving rise to the claim, or €10, whichever is lower.

12. Indemnification

You agree to defend, indemnify, and hold harmless Lexie, its owner, operator, affiliates, contractors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

your use or misuse of Lexie;
your violation of these Terms;
your violation of any law or third-party right;
any content or material you submit through Lexie;
any payment dispute or chargeback initiated by you.

13. Privacy and Data

When you interact with Lexie, certain information may be accessible or shared through Telegram and by your direct interaction with the bot. Telegram’s bot terms explain that bots may receive certain user data and that additional data may be shared directly by the user with the bot operator. ([Telegram][1])

By using Lexie, you understand and agree that:

messages, prompts, and usage data may be processed to operate and improve the bot;
payment-related information may be handled by third-party payment providers;
we are not responsible for Telegram’s systems, practices, or third-party payment processors.

You should publish a separate Privacy Policy alongside these Terms.

14. Third-Party Services

Lexie may rely on third-party services, including Telegram, payment providers, hosting infrastructure, analytics, and AI model providers.

We are not responsible for:

third-party outages;
third-party errors;
third-party data loss;
third-party terms or policies;
actions or omissions of third parties.

Your use of such services may also be subject to their own terms.

15. Changes to the Service or Terms

We may update Lexie or these Terms at any time, with or without prior notice. Updated Terms become effective when posted or otherwise made available through Lexie or another appropriate channel.

Your continued use of Lexie after any update means you accept the revised Terms.

16. Termination

We may suspend, restrict, or terminate your access to Lexie at any time, for any reason or no reason, with or without notice.

Upon termination:

your right to use Lexie ends immediately;
any unused paid access, credits, or features may be forfeited;
no refund will be issued.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in France, unless applicable law requires otherwise.
